Something like this happened in the town where I lived in the year before I entered high school, although the student was a few years older (17, I believe). A janitor walked in on a teacher (I think she was around 25) getting nailed by a football player on a lab bench. This teacher was absolutely hot, and never afraid to flaunt it.

The great part is that she had a twin sister (equally as hot) who taught in the middle school nearby. She kept her clothes on, though - or at least never got caught in the act. Too bad nobody ever got the twin teacher sandwich.

That happened in my highschool .. but it was weird b/c everyone knew and the girl was 16 and it wasnt considered illegal though b/c her parents gave her consent !! The teacher was like 30 something .. it was gross and so was he .. I dunno if there together still but they were for a long time.. He got fired regardless.. A really old teacher at the highschool walked in on them .. That had to be a petty site ! ewww

I think is nothing to serius to take her to court,the same guildy is the teacher and the boy, but in USA people get creacy of this stupid things, like you can not drink alcohol until you are 18 or 21 I think, the rules are bad made it.
