he drove over the curb..........the car landed on the curb, dented some rods and metal under my car.

and it turns out the DD doesnt have a liscence or insurance.

would my insurance cover this if i said i saw a dear and swerved to avoid it ?

also, my driver side window wont go up !

If you have comphrensive coverage they should. You might want to report him so they have someone to go after. Either way expect you rates to go up. Sorry for your misfortune.

            ^^^ designated driver

for when you're too drunk to drive, you hand the keys over to someone who is "sober" and can drive for you. or NOT in this case.

i'd take the tire iron to his ankle!

Oops! I thought you were saying that a Drunk driver hit you and didn't have insurance. Yeah maybe the swerve to avoid thing might be a better approach, since technically you were the one insured to drive the car.

Re:: My DD crashed my car !

I definitely wouldn't lie to the insurance company about you doing it. They may end up finding out that you hadn't been driving and then you could be arrested for insurance fraud. And if the law finds out you were supposedly drinking and driving then you could go to jail on that too.

I'm sure this has happened plenty of times before and I would go to my insurance agent and explain your situation. They're there to help you out and not go after you unless you lie to them because from what you said you really didn't do anything wrong.

Sounds like your DD is the main one at fault here imo. Only thing I'd blame you for is allowing this person without a license or insurance drive your vehicle.

I have a lot of expeerience in this area. Don't mention your friend at all. Say that u were driving (at about 2am) and a car cut u off and then the other car left the seen because they were probably drunk. So now u are left with a busted car. It should be a no fault write up because in canada now they have to believe what u ssay. Just make sure that it is the same in your country. I have had two DUI accidents and never got charged or even had to pay my deductible. And my insurance never went up...

phoenix, sorry to hear that dude. I agree 100% with Superdave that you shouldn't lie, your situation isn't nearly as bad as it could be. Just tell em what's up and they'll hook you up much better than if you got caught lying.
