He can't do anything about people with a mic on the dancefloor recording his set, but if it's stipulated in his contract, the club is in breach of it, simple as that.
I think we sorta take it for granted with the prevalence of digital media and the internet, that all these sets will be floating around for us to download, just look at some requests in P&R. Maybe we're more accustomed to the digital age and Tenaglia is just not moving with the times.
But would you walk into a concert and record a pianist's performance? Or sit in the cinema with a videocam to record a movie? I see it as the same thing, doesn't matter if it's on the dancefloor, in a concert hall, or in a cinema.
Ultimately Tenaglia and every other DJ are the performers and their wishes or idiosyncracies should be respected.
