    Rapidshare.com shut down by German court

    Damn, this sux. I loved that site!

    What seems screwy is the message that maybe youtube and myspace are to be affected somehow. What about every other link site for file sharing and storage?



    GEMA obtains injunctions against data exchange services

    The German collecting society GEMA has obtained from the District Court in Cologne temporary injunctions against the operator of the data exchange services www.rapidshare.de and www.rapidshare.com. The latter is said to have used copyright protected works of GEMA members in an unlawful fashion. The services make virtual storage space available into which users can upload content that is thereby made publicly available to other users. GEMA spokesman Hans-Herwig Geyer told heise online that the services should not be allowed to continue to operate in their present form. The collecting society is now demanding that the operator provide details on how many copyright protected works of GEMA members are currently stored on the said sites.


    According to GEMA, the service www.rapidshare.de particular has at times boasted of making some 15 million files available to its users. The operator had however failed to obtain from GEMA a license for making copyright protected files available, the collecting society spokesman observed. To date RapidShare had claimed not to have any knowledge of the content uploaded by the users and of not being in a position to control the same, the spokesman continued. Through its injunctions the District Court in Cologne had now however made it clear to the company that the fact that it was the users and not the operator of the services that uploaded the content onto the sites did not, from a legal point of view, lessen the operator’s liability for copyright infringements that occurred within the context of the services, the spokesman added.

    Harald Heker, the chairman of the executive board of GEMA, believes the court's decisions will have repercussions on the way "Web 2.0 services" such as YouTube and MySpace will be treated in future. What the decisions according to Mr. Heker show is that "the mere circumstance of shifting acts of use to users and the purported inability of the operator to control content do not relieve the operator of a service from the copyright liability he/she/it possesses for the content made available for download from the operator's website(s)."       from what it looks like to me..

      rapidshare briefcase is taken offline, direct downloads and urls are still active.

      I can also login to my premium account, im nabbing kosmas epsillion

        I'm using it now as well, and damn glad since I paid for my premium only a week ago. Seems the owner is going to defy the court ruling or make it unusuable in Germany only. If I understood that right. Anyway, its working now, and thats a great thing. I love a link site without all the garbage, at least for me since I bought a premium, its fast and no waits, no adds, no popups.

            Rapidshare lost.

            German owned yet globally popular file hosting site Rapidshare may be heading to the Deadpool after a German court found that it was liable for copyrighted files uploaded to the service.

            The German equivalent of the RIAA, GEMA took Rapidshare to court over hosting copyright infringing files and at a court hearing January 23, won. The court found that Rapidshare must take responsibility for infringing files hosted on its service


            According to a report at TorrentFreak, the problem with this case (compared to previous cases which simply demanded files be taken down) is that the court went one step further and said that



            Rapidshare must take preventative action against infringing uploads; essentially meaning that Rapidshare should screen every upload, a hard, if not impossible task, that will “likely end up with a service that’s not worth operating, so they may decide to shut it down completely.”


            The case may have wider implications, particularly in terms of offering file hosting services to users in Germany. Other file sharing sites may ban German users, and there’s also a risk that now that there has been a win in Germany, similar groups to the RIAA/ GEMA in other nations may try to get similar rulings.
