I believe the law looks at what measure of force could have been used other than his vehicle to subdue the little shit!
Bad luck tho but in similar circumstances, if i was attacked in my car i would have done the same thing!

I want to know what he was excpected to have done? What was the proper choice of a action? From the sound of it, it sounded like he just punched the gas to get away and ran the guy over accidentally as part of the process....not like he punch the gas, accelerated, hit the hand breake, pulled a sweet 180...sat there revving the engine...VROOOOM VROOOOM....squeeled the tires, smoke flying everywhere....CHARGE! and......THUMP!

To play devil's advocate, take a look at this:
The victim suffered a broken leg and collar bone and punctured lung and spent over six weeks in hospital after Armstrong mounted the pavement in his vehicle and drove it into him as he stood in nearby bushes.
Self-defense gives you permission to exert whatever force you need to exert to extricate yourself from a situation, and probably extends to the force necessary to ensure that you're not going to be in danger again seconds later. It doesn't give you permission to go too far beyond that, though -- if it reaches a point where it looks like it has less to do with your safety and more with vengeance, you lose that "self-defense" protection for your actions. Being accosted doesn't grant you a roving commission to be a thug yourself.
Again, just playing devil's advocate here. The reality is that we don't know the whole story and if the reporter gave the whole story, it might not have made for such an interesting article. Food for thought.Comment

It's hard to tell since the article was apparently written by a confused moron, but it sounds like the kid busted the guy's window and then beat like hell out of there...and the old man got pissed, floored it, and intercepted the kid at the bushes off the road.
It's one thing to run someone over when they're on your car hood pumping bullets into your winshield; it's another to deliberately chase someone down as they're retreating after the episode of danger has clearly already ended (even if that person was an asshole).mixes: www.waxdj.com/miroslavComment

i'm pretty sure in texas it's still legal to shoot someone that trespasses on your property. this might be a little excessive, but in my opinion people everywhere are turning into a bunch of pussy-wussies and it makes me sick, you should be able to defend yourself in any situation if it involves you getting hurt or killed. there needs to be some sort of wild-west type laws brought back imo.Fly? a friend asked a cop once what to do if someone broke into his house. the cop told him to shoot to kill, but when the police arrived to tell them ' i tried to end the threat.' it can put you in a bad situation if you tell them you tried to kill said person.Don't let anyone drive you crazy when you know it's in walking distance.

It sounds like Armstrong wasn't in immediate danger from his harrasser so there's no self-defence case. I mean, if you got mugged, and you hunted down the mugger and took matters into your own hand, you'll be held accountable too. Or you could wear lycra tights and a bat mask.
