I certainly hope for your sake that you're selling it for face value.

        Skahound: It is face value.

Jibbers: No young bartender today. Rubyraks said he would take me out for a romantic dinner and a lot of anal afterwards. Hopefully he won't fall asleep while I'm pounding him... again.

you don't have to sell them for face value.

you sell something like a baseball cap for $500 and include the tickets for free.

(that's the legal way around it)

Brother-in-law is an attorney in South Florida (actually just represented the Dolphins vs. Ricky Williams) and was telling me one time that in fact that isn't a defense. I don't remember exactly what the latin term is that he used but said that basically values are somewhat common sense and the FMV of a baseball cap is not $500 so that defense wouldn't work in court. I'll have to find out what it's called.

actually, your brother in law needs to go back to law school. lol.

but, i should have used a better example. what you do is sell baseball cards, where the future value may in fact be worth $500 (because noone really knows how good player X is going to be, and what the future worth of the card will be.) You're taking a chance on the baseball card, and hey, FREE TICKETS!!

this is legal. and ebay allows it.

The cap thing was a bad example.

Ok...makes more sense now. Gotta love the legal system!
