He's saying that If he can 'prove' that Phelps smoked marijuana he's going to file charges against him. Now Phelps has confessed, but how would they ever be able to prove that he smoked marijuana last November.A COUNTY sheriff from South Caroloina yesterday warned that he will charge Michael Phelps with a crime if an investigation determines the Olympic star smoked marijuana.

Better start swimming and running now Mr. Phelps. I wonder if he smokes on the regular, or just occasionally? That would make a big difference -- test wise.
He could always bleech his hair, to bypass the hair follicle test.

No, not easily. Even though pot is a scheduled substance in the US, the government cannot just take a blood or hair sample because they suspect that you have smoked it in the past. As much as I disagree with the war on drugs at least some rights of our freedom are still intact, b/c there definitely are other countries where the government can drug test you just for the hell of it.
Additionally:
1. Bongs are not illegal to posses, and the photo certainly doesn't show what it was that he was smoking
2. Phelps never admitted that he actually smoked bud, he only said that he regrets his 'bad judgement'
This is just another example of a hard-ass sheriff who has absolutely nothing better to do than run his mouth to get some media attention and waste his own time opposed to stopping real criminals that cause harm to society.Comment

Yeah it'll probably pass out of his system quickly assuming he's not a habitual smoker. Think I read somewhere the fella consumes 12000 calories a day. Can't imagine him being stoned habitually, there's no way his sport allows that. But swimming laps is pretty boring, getting stoned would be one way around that!
