      If you're caught with contraband then proven guilty for procession you can be issued random drug tests during your probationary period.

      Some states can also drug test you if you're driving a vehicle and a police officer suspects that you are under the influence (i.e. Michigan). Or say if you wrecked your car and injured someone and the police suspect that you're under the influence, then in many states they can issue a drug test.

      But with the exception of the two cases above, 'just having THC in your system' is not illegal, it is only illegal when you are in actual possession of the controlled substance or related (and used) contraband.

      For instance, look at all of the celebrities and musicians who incriminate themselves in interviews and photos in the magazine High Times...not one of them have ever been prosecuted for their contribution to that.

        Well what do ya know...

        The same Richland Co. Sheriff says he's ending his investigation b/c there's not enough evidence to press charges on anyone at the party. He said that without physical evidence and an admission of guilt there is nothing that can be done. So a picture is not enough...duh!!

        What a waste of the sheriff's time and tax payer's money!
