    c) Posting the material online is not really illegal as such. It's more so what is done with the mix after it is downloaded. If it's private use I don't see a problem. If you're playing it in a commerical environment, I'm sure there are royalty issues by doing this.

    Just my thoughts anyway...
    No it's not what I am trying to say. I have said exactly what I meant. There obviously is a crackdown happening or this wouldn't have happened to me. I've also just skimmed a little google and it's happening elsewhere.

    While your points are logical and make sense they are not a reflection of what is happening in the real world.

    A. Since when has that stopped them trying ?? and they don't have to get everyone, just the soft targets.

    B. They do benefit, but surprise, surprise they also like to be paid for their work. If everyone just says Hey I'm giving the artist exposure and doesn't pay, who does?? But this is the crux of the matter, surely if a DJ does buy the track, these tracks are designed to be played in DJ sets, how can they possibly be unlawful. ???
    C. Obviously it was deemed to be illegal or they would not have been able to remove my link. Which raises another question. Whose judgment?? What you say here SHOULD be reality. But it isn't ! Maybe we should all be a bit more aware so that we can make it real. Big ask I know

      I think the actual cause is that even though tunes are in a 'mix', you still have to have a license from a licensing authority from all of the labels to play such tunes. This is why NE Expeditions has a different US and UK tracklisting, if you can't clear license rights for EVERY song on your mix, you can't legally sell it without risk of violating copyright.

      This is why peoples whitelabel remixes of Billie Jean etc will never be published via an official channel because whoever owns the rights to MJ's music would never allow this to happen without a 1 million dollar figure coming their way, which a small bedroom DJ will no way be ever to pay.

      Technically if Diggers and Bedrock/Plastic City/Good Looking/every other dance label decided to lawyer up, they could demand any mixes with any tunes of theirs on this site be taken down or we could get sued because they haven't given us explicit permission to play their music. This isn't going to happen because everyone who loves this music knows that the whole spirit has always been share mixes, explore tunes, buy music profit. This is much different than the new U2 and Lady Gaga cds where there are millions to be made.

      Do you know if you are one of those small wedding DJ guys who gets paid to bring your mobile music setup to every wedding reception in town that you can get fined if you don't have an ASCAP license? You have to pay a fee to play these tunes in public places. I even heard of a while back that the NFL was trying to sue some bar(s) which had tv's greater than a certain size (since tv's are getting so big now) because it constituted a "public performance", and the NFL never granted them "public performance" rights. That warning is there, just listen to the very tail end of any NFL broadcast and you will here this disclaimer. It's all just about $, luckily this is still pretty low on the $ factor, so suing us vs suing Justin Beiber fans isnt economically viable, so Beiber it is.

        Clearly no one is selling their promo mixes.

        We have similar laws here , for djs . Premises have to pay for a license.

        Google is proving a rich source at the moment. Some really interesting stuff One thing I found is that ANYONE can get one of these notices issued and there are a lot of sites that will tell you how to do it.

          I think you might be over thinking this. The file got deleted by mistake, you were hassling them, standard response is to send that letter as it's easier than actually spending time in digging around to see what has gone on.

          Do you think they really have the time to go through all the files and listen to them. They know that by sending out that letter it will cover 90% of file uploaders and put an end to all other technical questions in one go.

            ^^^Err, that letter had my file number in it. I thought the same as you at one stage when they were stalling, obviously because they couldn't be stuffed. I must say it just made me angrier that they would be that stupid But there is now something I can actually confirm. And I will be looking at the best way to do that.

            You actually didn't read very much did you.?? The letter wasn't from them. Of course they don't listen. It would be based on a DMCA report.


            As long as we accept this sort of shit we will continue to get it served up to us.

              No but copyright infringement isn't just about selling the product, its about recreating it. If I did a mix and gave it away for free I would still be committing a crime because I haven't approached the artists who made the tracks on it for their permission to use it. The crime is copying it which is illegal. Copying it and selling it is just a bigger crime. 99% of music available on the internet is illegal

There is every chance someone has downloaded one of my links and thought they might teach me a lesson for being a smart arse and reported it without thinking through the consequences.
